Bongani Modolo is a proud and doting father, his son being the first person he introduces while visiting Simpsons Attorneys for his interview. Being a heartfelt family man, it was while he was on his way to help another family member that he ran out of petrol and had to push his car in the dark. A taxi drove over his foot.

The nightmare begins

Such began a nightmare where he was first denied private medical care and later also his claim for compensation rejected by the Road Accident Fund, whom he approached directly. They claimed that he was a fraud and faked his injury.

At the time of the accident he did not have his medical aid card with him and the ambulance refused to take him to Melomed Private Hospital, but instead left him at Tygerberg Hospital, where he had to wait for hours in the emergency room to be helped, while in severe pain. Clearly still traumatised by this experience, he says that he eventually managed to obtain his medical aid card but was only transferred to Melomed the next day.

Since he was the only breadwinner, he immediately went back to work as a Golden Arrow bus driver, after spending 3 weeks in hospital. He still experienced quite a lot of pain for a year after the accident, as his ankle kept on swelling and inhibited his ability to drive safely, while transporting other passengers. He eventually also lost his job.

Denied help from RAF

Being denied help from the Road Accident Fund, he clearly felt isolated and pushed aside. He also felt that no one believed in him and as a proud man, not being able to support his family, made it even worse.

Bongani was referred to Simpsons Attorneys by another client and was introduced to Collette Julyan, a personal injury lawyer, who fought to secure R980 000 in compensation from the Road Accident Fund for his pain, loss of income and suffering.
