Andrew Davids is soft-spoken, yet has a heartwarming smile. He came to Simpsons Attorneys today to tell the story of how they helped him get his life back on track after an accident which occurred on 2 April 2012, in which he was a cyclist.
What happened
Andrew was on his way to KFC Tyger Valley, where he worked as Training Supervisor, was knocked off his bicycle by a car, getting caught under the car and dragged for a further 20 meters. Emergency services struggled to remove him from under the car as he was in an unconscious state. They took him to Tygerberg Hospital. He sustained abrasions and lacerations to his head, multiple rib fractures and bleeding and experienced immense pain and discomfort after the accident.
Bedridden
A difficult 3 months followed at home where he was bedridden. After finally returning to work, he soon realised that due to his brain injuries he could no longer handle the mental pressure, or his body the intense retail environment and hours. He suffers from post-traumatic stress disorder, struggles to sleep, becomes extremely anxious when riding in a taxi and is currently seeing a psychologist at a day hospital as well as taking medication to help him cope.
A cry for help
After the accident, he approached a personal injury lawyer in Cape Town who indicated that they cannot help him and told him to approach the Road Accident Fund directly. The RAF treated him unfairly and offered him R3000 for his injuries with no regard for his loss of income, pain and suffering.
At 47 he is unemployed and is currently residing in an informal settlement, struggling to find work. He is keeping busy as a janitor.
Andrew pauses, trying to formulate his words. “All I want is to improve the living conditions of my family.” He is married with two children, age 2 and 4. “I also just want to thank Simpsons and Ms Julyan for everything they have done for me so far, I really appreciate it”.
