Mr X sustained severe head injuries due to a motor vehicle accident in 2009 and was admitted to hospital. While in hospital he was approached by the Road Accident Fund’s self-help department who undertook to assist Mr X with his claim. He was advised that, as he did not have funds for an attorney, this would be a more affordable and effective route to follow – unfortunately the contrary was proven.

In 2013, 4 years later, Mr X found himself feeling frustrated about the progress of his claim with the Road Accident Fund and so he decided to look elsewhere for assistance.

He approached Simpsons and consulted with our legal team. Simpsons immediately agreed to assist Mr X and undertook to do so without upfront payment of our fees and/or disbursements (contingency fee agreement).

When we met Mr X we could not believe our eyes, Mr X was a living miracle.  His injuries were of a serious nature, he was cosmetically disfigured as he had damaged a large part of his skull and required surgical intervention. We ensured Mr X that he had found the right attorneys and that we would not rest until the Road Accident Fund had assisted him.

Simpsons immediately contacted the Road Accident Fund and, in light of the neglect this client had suffered in their hands, insisted that they come to the party so Mr X can receive his operation on an urgent basis.  The merits of the matter were settled with an apportionment which is usually deductible from medical expenses paid out by the Road Accident Fund, the client having to fit the balance.

Mr X was unable to afford the balance of the operation which cost R343 000.00. Simpsons persisted and finally the Road Accident Fund has agreed to pay 100% of the costs associated with this operation.

Mr X received will be receiving his operation in private care and has found an attorney dedicated to fighting for his rights.
