After years of litigation Simpsons Attorneys have proved successful in the Western Cape High Court once again.
Our client, who we will refer to as Mr Smith for purposes of confidentiality, sustained serious injuries to his spine and elbow in 2007 when he slipped and fell.
Mr Smith, a plumber by trade, had been working at a leading seafood franchise in Tygervalley. He completed the job and was sent down to the kitchen to collect payment. Upon passing through the curtain, which separated the restaurant from the kitchen, Mr Smith stepped onto a black bag which had been used to cover up a spillage of oil. The consequences were life changing for him as his capacity to work and be productive was dramatically affected.
Mr Smith was transported to Milnerton Mediclinic by ambulance where he was hospitalised and received treatment.
Upon his release he contacted Simpsons Attorneys and we have assisted him in his fight ever since. Through the help of various specialists we were able to prove that negligence existed and most importantly that Mr Smith was entitled to compensation for the following:
- Past and future medical expenses.
- General damages (Pain and suffering, loss of amenities etc).
- Past and future loss of income.
The matter was set down for trial on 19 August 2014 however before a Judge could be allocated the Defendant made a reasonable offer which Mr Smith accepted.
